Meet Son der Guard

A senior VP in Fake News, HR knew him as Sexy Harry because he was a walking, talking sexual harassment complaint. He went from one sexual harassment incident to another, garnering disrespect along the way. It was his job to provide oversight of the Fake News Research department. Such was his disregard for human rights that to sign off the termination of a vulnerable person with disabilities was preferable to him than to check the validity of the grounds for dismissal. He had never taken the time to get to know Tommy Bear, an employee with over ten years service.

HR hotline

HR’s phone rings. The rep runs off, mouthing, “Uh-oh! Sexy Harry spotted on the second floor.” So how did Son der Guard hold down a senior level job in Fake News? They don’t tell you that at Fake News Symposium. Watch this space. 

Shoot the whistleblower 
An employee in Son der Guard’s organization filed complaint for discrimination and retaliation with EEOC. Fake News' response to EEOC on Son der Guard’s behalf was to place a precondition that they would only attend mediation if the outcome was for the employee to be fired there and then for filing complaint. EEOC were dismayed that Fake News would expect them to collude in firing the whistleblower on their premises without hearing the complaint. 

Fake News shareholders have asked tor an explanation and accountability for this breach of human rights. They have also asked if this is the quality of advice Fake News gives clients. How will Fake News respond? Watch this space. 

Son der Guard’s legacy - A litany of legal violations

Under Son der Guard’s watch, when he was accountable for oversight of Fake News Research, the most vulnerable of employees, the individual with disabilities, was not invited to exit interview. The result is that Fake News has been furnished with this list of outstanding issues:-

 

- EEOC complaint leading to attempted retaliation in the form of wrongful termination for being a whistleblower, prevented by EEOC 

- EEOC mediated career development plan not administered, reviewed, updated or completed

- FMLA disability leave entitlement not administered 

- bonus unpaid despite coverage for project work while on disability leave

- disability pay apparently not administered

- disability leave and pay withheld despite making payroll deductions up to his last day and despite request for disability leave at the last team meeting

- fraudulent misinformation that he had a performance plan for the year ahead only to be terminated days later 

- fraudulent misinformation and libellous contention that he put the phone down on his supervisor hours after the supervisor was told of phone and internet issues

- fraudulent misinformation that his last meeting with HR and next level manager was for project planning but was actually entrapment while on disability leave to give notice of termination, making preparation impossible

- inverted role with supervisor on over 20 projects despite ADA requirement that employees with disabilities not be set standards above their level of job

- ADA needs assessment with HR for resumption of work not booked

- ADA needs assessment for career development not arranged

- ADA needs assessment for disciplinary action overlooked

- a culture that was not supportive of complaints about bullying, duress and sexual harassment

- sexual harassment by supervisor, telling him to date a colleague and “too picky when it comes to women”

- termination without cause in breach of ADA requirement for proof that cause is not disability

- reference and re-engagement liability while fabricated disciplinary warning remains on record 

- discrimination by failing to set up customary exit interview to resolve final issues 

- NDA on record despite protests of wrongful termination due to duress - bullying, harassment, breach of Public Policy and fraudulent misinformation

Fake News subsequently fired Son der Guard. However, they don’t tell you at Fake News Symposium that they have done nothing to clear up the mess, the unfinished business, for which he had oversight but neglected while indulging in his own personal dirty practices. Will Fake News wake up from sleepy hollow, take accountability and prevent a worldwide shareholder-led campaign to expose the corporate litany of violations against human rights? Watch this space.
